SOLITAIRE WELL END USER LICENSE AGREEMENT
License Agreement
You should carefully read the following terms and conditions before using this software.
This is a legal end user license agreement ("License") between you ("Licensee") and GranderSoft Development ("Author") covering the computer program of "Solitaire Well" which includes program files, data files and documentation (hereinafter "Software"). BY INSTALLING, COPYING OR IN ANY OTHER WAY USING THE PRODUCT, YOU AUTOMATICALLY ACCEPT ALL THE TERMS AND CONDITIONS OF THE PRESENT LICENSE AGREEMENT. IN CASE YOU DO NOT AGREE WITH TERMS AND CONDITIONS OF THE PRESENT LICENSE AGREEMENT, DO NOT INSTALL OR USE THE PRODUCT.
1. Ownership
The Software and all copies of the Software are owned by Author and are protected by copyright, trademark and trade secret laws and international treaty provisions. The Software is licensed and not sold.
2. Copyright
Licensee acknowledges that the Software is protected by copyright. Licensee may not copy, photocopy, reproduce, translate, modify, rent, lease, sublicense, adapt or create derivative works based on the Software or Documentation. You may not reverse engineer, decompile or disassemble the Software.
3. Grant of License
Author grants you the right to use the Software in accordance with the terms of this License Agreement. You may load the Software into RAM as well as install it on a hard disk or other storage device.
4. Shareware version License
The Software is shareware. The Software is not free or public domain and is subject to copyright. You may distribute copies of the shareware version of the Software freely to other users, provided that any copy must contain the original, unaltered files and proprietary notices. You have the ability to register the shareware version at any time by purchasing a registration code from Author, and the Registered version License below will then apply.
5. Registered version License
When you buy the Software, you will receive a personal registration code that will allow you to register the demo version to become the fully functional version. You agree not to distribute your registration code to others and to use it only for your own personal use. You acknowledge that distribution of your registration code to others, whether intentional or unintentional, could damage Author both financially and professionally. Therefore, you agree to keep your registration code confidential. Any unauthorized distribution of your registration code or the registered version of the Software will result in immediate and automatic termination of your license.
6. Disclaimer of warranty and limitation of liability
Author does not warrant or make any representations that the functions contained in the Software will meet licensee's requirements or that the operation of the Software will be uninterrupted or error-free.
The Software is provided "AS IS" without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose, or of any other type, whether express or implied, and to any remedy against Author or and/or its Licensors, whether in contract, tort or otherwise. In any event, Author's liability shall not exceed the amount Licensee originally paid for the Software. Licensee agrees that neither Author nor its employees, management, or anyone else who has been involved in the creation, production or delivery of the Software shall be liable for any indirect, incidental, special, or consequential damages (including without limitation, loss of profits, revenue, data or use, business interruption, loss or inaccuracy of information) incurred by Licensee or any third party in connection with or arising out of use of the Software, even if Author has been advised of the possibility of such damages.
7. Termination of License
The License will terminate automatically if the Licensee fails to comply with any provision of the License or upon transfer of the Software and Documentation.
8. Acknowledgment
Licensee acknowledges that Licensee has read the Agreement in full has fully understood its terms and agrees to be bound thereby. The Agreement contains the complete and exclusive agreement between the parties and supersedes all proposals or prior agreements, oral or written, and any other communications between the parties and supersedes all proposals or prior agreements, oral and written, and any other communications between the parties relating to the subject matter of the Agreement.
